Parent & Student Terms of Service

For individual parent/guardian users, children/students and school-linked use of the Bamio app; school commercial use is governed separately

1. Acceptance of these Terms

These Parent & Student Terms of Service (“Terms”) govern access to and use of the Bamio mobile application, bamio.in and related parent/student services (together, the “Services”) operated by Balraj Singh, sole proprietor of KR Edtech Solutions, operating under the brand name “Bamio” (“Bamio”, “we”, “us” or “our”).

  • By creating a parent account, creating or approving a child profile, linking a student account, purchasing a subscription (where paid subscriptions are offered), or allowing a child to use the Services, the accepting adult agrees to these Terms and acknowledges the Bamio Privacy Policy.
  • The accepting person must be at least 18 years old and have authority to accept these Terms for themselves and, where applicable, for the child.
  • A child does not independently enter the full consumer contract merely by using a child profile. The parent/guardian or another legally authorized adult is responsible for the child’s permitted use, except where a valid school-managed arrangement applies.
  • A school’s purchase, deployment and institutional obligations are governed by a separate School Services Agreement and, where applicable, DPA. These Terms do not replace that school contract.

2. Definitions

Term Meaning
Bamio / we / us / our Balraj Singh, sole proprietor of KR Edtech Solutions, operating under the brand name “Bamio” and any lawful successor operating the Services.
Parent user A parent or legal guardian who creates, approves or manages a child profile.
Child / Student A child or student using the Services under a parent-managed or school-linked account.
School / Institution A school or educational institution using Bamio under a separate School Services Agreement.
School-linked account A student account connected to a school, class, section, teacher or administrator.
User Content Voice, audio, video, text, photos, PDFs, answers, homework, notes, diary entries and other content submitted by a parent or child.
School Content Assignments, worksheets, questions, instructions, marks/records, teacher feedback and other content supplied or controlled by a school.
AI Output AI-assisted explanations, feedback, summaries, reports, recommendations, plans, questions, answers or other generated material.

3. Description of the Services

Bamio is an educational technology platform. Features may change over time and may include:

  • SpeakUp — spoken-language practice with AI-assisted transcription and educational feedback.
  • Spotlight — video/presentation practice with AI-assisted educational feedback.
  • Voice Diary — audio reflection and learning-journal features with transcription, summaries or insights.
  • My Bag — uploads of photos, PDFs and study material for AI-assisted tutoring, OCR/vision assistance and question answering.
  • Quest, drills, lessons and exercise engines — learning activities across supported subjects and skills.
  • Study planning, tasks, timetables and habit-building tools.
  • School-linked features — assignments, attendance, marks, reports, exercises, teacher feedback and other authorized school workflows delivered through the combined Bamio platform.

All Services are for educational support. Bamio is not a medical, psychological, psychiatric, therapeutic, clinical, speech-language pathology, diagnostic or emergency service.

4. Eligibility and account types

4.1 Parent accounts

A parent or legal guardian aged 18 or above may create and manage a parent account and child profile. Bamio may require age, authority or identity verification where legally required or reasonably needed to protect a child account.

4.2 Child profiles

A child profile must be created, approved or linked through a parent/guardian or an authorized school workflow with the notices and permissions required for that workflow. Children must use the Services in an age-appropriate and lawful manner.

4.3 School-linked accounts

If a student is linked to a school, school assignments, attendance, marks, teacher feedback, reports and other school-linked information may appear in the same app. Authorized school users may see school-linked submissions and reports according to role permissions and the Privacy Policy.

4.4 School staff and institutional authority

Teachers and administrators may be subject to separate Staff Acceptable Use terms and the School Services Agreement. A teacher’s routine use of Bamio does not by itself authorize the teacher to amend pricing, the DPA or the school’s commercial contract unless the teacher is an authorized signatory.

5. Cross-platform school delivery and data separation

Authorized school users may upload, assign or create School Content through Bamio School interfaces and make that content available to students linked to the relevant school, class or section. Bamio does not make School Content publicly available by default.

A child’s direct personal content is intended to remain separate from School Content unless the child/parent submits it as part of a school assignment or shares it through a school-linked feature. The Privacy Policy explains how Bamio treats direct family processing, school-directed processing and Bamio’s own operational processing.

6. Parent and guardian responsibilities

  • Supervise the child’s use and decide whether features are suitable for the child’s age, learning needs and context.
  • Keep parent credentials, PINs and recovery information secure and do not share administrator/parent credentials with a child or unauthorized person.
  • Provide accurate account information and promptly update material changes.
  • Review AI Output and educational feedback before relying on it for important educational decisions.
  • Avoid uploading unnecessary sensitive information, identity documents, financial information, passwords, medical records or other highly private information unless a specific Bamio workflow clearly requires and explains it.
  • Notify Bamio at admin@bamio.in if account access, school data or child information may have been compromised.

7. Acceptable use

You must use the Services only for lawful educational purposes. You must not, and must take reasonable steps to ensure a child using your account does not:

  • Use the Services for unlawful, abusive, exploitative, threatening, harassing, discriminatory or otherwise harmful purposes.
  • Upload content that infringes copyright, privacy, confidentiality, publicity or other rights.
  • Upload full copyrighted textbooks, paid coaching modules, proprietary test series, confidential exam papers, pirated PDFs or other material without authorization.
  • Attempt to access another user’s account, another school/tenant, class, section, transcript, report, server or network without permission.
  • Use bots, scraping, automated extraction, reverse engineering, security testing or load testing without written authorization, except to the extent a restriction is prohibited by applicable law.
  • Copy, sell, redistribute or publicly expose Bamio content, School Content or another user’s private content except as permitted by the Services and applicable rights.
  • Interfere with security, availability, integrity or performance of the Services or try to bypass rate limits, authentication or role controls.

Bamio may restrict, suspend or terminate access and may notify a parent or school where Bamio reasonably believes the Terms, school rules, rights of others or applicable law have been violated.

8. User Content and permissions granted to Bamio

8.1 Ownership

You and/or the relevant child retain ownership of User Content to the extent provided by law, subject to rights held by schools, teachers, publishers or other third parties. School Content remains subject to the rights of the school and its licensors.

8.2 Limited licence to operate the Services

You grant Bamio a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit, display and analyze User Content only as reasonably needed to provide, secure, support and personalize the Services for you/the child and authorized school-linked users as described in the Privacy Policy. This licence ends when the content is deleted from active systems, except to the extent temporary backup, security, legal or dispute retention remains necessary.

8.3 Rights in uploaded materials

You must have the right or permission to upload the material for the intended educational use. Bamio will investigate reported concerns and may act to address infringement, privacy, safety, legal or school-policy issues in accordance with its available procedures and applicable law.

When you or your child share a photo, PDF, recording or other material with Bamio, you are confirming that you have the right to share it for your child’s learning. If you are not sure, please do not upload it. If someone raises a rights complaint about material shared from your account, Bamio will investigate and take appropriate action in accordance with its available procedures and applicable law, and we will let you know.

9. AI, personalization and external providers

9.1 Same-student personalization

Bamio may use the student’s own answers, scores, attempts, progress, practice frequency, teacher feedback and AI feedback history to personalize learning recommendations and reports for that same student.

9.2 External AI and transcription providers

Bamio may use external providers, which may include Google Gemini, DeepInfra, Groq and other providers listed in the current Privacy Policy/subprocessor notice, to perform AI inference, transcription, OCR/vision or fallback processing. Only the information reasonably needed for the relevant feature should be sent.

9.3 General-purpose model training

Bamio does not intentionally submit a child’s personal data, User Content or School Content to an external provider for the purpose of training that provider’s public or general-purpose AI model. Provider contractual terms, retention settings and technical options differ and are described or referenced in the Privacy Policy. These Terms do not create a stronger provider-specific guarantee than Bamio has actually verified and implemented.

9.4 Aggregated/de-identified improvement

Bamio may use aggregated or de-identified statistics to improve reliability, safety, educational quality and product design, provided the information is not reasonably linkable to a particular child, parent, teacher or school.

10. AI Output — important limitations

  • AI Output may be incomplete, inaccurate, inappropriate, outdated or unsuitable for a particular learner.
  • AI systems may sometimes produce material similar to public or existing educational content because of the nature of generative systems.
  • Parents, teachers and institutions remain responsible for reviewing AI Output before relying on it.
  • Bamio does not diagnose, treat, screen for or predict medical, mental-health, psychological, psychiatric, developmental, speech-language pathology or learning-disability conditions. Feedback describing observable communication behaviours — for example signs of nervousness during a practice recording — is coaching feedback on that performance, not a clinical assessment.
  • Bamio should not be used as the sole basis for academic promotion, grading, disciplinary action, attendance sanctions, school evaluation, health assessment or another decision with legal or similarly significant effect.

11. Voice, audio, video and identity-related processing

Bamio may process voice, audio, video, face images and speech inputs to provide transcription, presentation practice, feedback, journaling and educational reports. Bamio does not use this content for biometric identification or biometric authentication.

Where an explicitly enabled school workflow records a government-ID reference, Bamio accepts and retains only the last four characters of the number. Do not upload full Aadhaar cards, PAN cards, birth certificates or full government-identification numbers to Bamio, and do not send them through ordinary support channels. The Privacy Policy controls how the last-four reference is processed.

12. Privacy and data protection

Bamio’s collection, use, sharing, storage, retention and deletion of personal data are described in the Privacy Policy, which forms part of these Terms. School-linked records may also be governed by a School Services Agreement and DPA between Bamio and the school. If there is a conflict about school-controlled processing, the school agreement/DPA governs the institution’s processing instructions while mandatory user/data-protection rights continue to apply.

13. Subscriptions, payments, taxes and refunds

If paid subscriptions or services are offered, the price, billing period, renewal terms, trial terms and material conditions will be shown before purchase. App-store purchases may be processed by Apple or Google under their payment and refund rules, and Bamio ordinarily does not receive full card details from those transactions.

The amount shown at checkout or on the applicable invoice will state the amount payable and any taxes that Bamio is legally required to charge or collect. Where Bamio becomes required by law to add GST or another tax to a directly invoiced service, that tax may be charged in addition to the pre-tax fee unless the offer expressly states that taxes are included. Nothing in this clause overrides mandatory consumer price-display requirements.

Cancellations and refunds are subject to the purchase channel’s rules, any specific Bamio refund policy presented before purchase, and mandatory rights under applicable consumer law.

14. Service availability, pilots and changes

Bamio may be offered in beta, pilot, school pilot, trial, paid or public-release modes. We use reasonable efforts to provide a reliable service but do not guarantee uninterrupted or error-free availability.

  • Features may change, be delayed, temporarily disabled or removed.
  • AI output and provider availability may change over time.
  • Data may be delayed or temporarily unavailable because of technical incidents or third-party outages.
  • Users and schools should keep independent copies of important educational records where loss would cause material harm.
  • Bamio should not be the sole system of record for critical school, legal or safeguarding records unless a written school agreement expressly provides otherwise.

15. Bamio intellectual property

Bamio and its licensors own the Services and related software, design, interface, brand, mascot, Bamio-created lesson materials, feedback templates, proprietary prompts/workflows, databases, compilations and AI-assisted tools. Except for the limited right to use the Services under these Terms, no Bamio intellectual-property rights are transferred to you.

You may not copy, modify, distribute, sell, lease, scrape, extract, reverse engineer or commercially exploit Bamio intellectual property except as expressly permitted in writing or where applicable law does not allow the restriction.

16. Copyright and other rights complaints

If you believe material on Bamio infringes copyright or another right, contact admin@bamio.in with details of the work/right, the allegedly infringing content, its location/identifier, your ownership or authorization details and your contact information. Bamio will review and investigate valid notices and act on them — which may include removing or restricting access to the material — and may seek more information, notify the uploader/parent/school and cooperate with lawful requests.

A separate dedicated copyright address may be published after it is created and actively monitored.

17. Third-party services

Bamio relies on third-party hosting, database, AI, transcription, email, push-notification, app-distribution and payment services. Those providers may process data as described in the Privacy Policy and their applicable terms. Bamio is responsible for selecting and managing providers to the extent required by applicable law and contract, but cannot guarantee that every third-party service will be continuously available.

18. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available”. Bamio does not guarantee the accuracy of AI Output, uninterrupted availability, data integrity, fitness for a particular educational purpose, or any specific academic outcome. Nothing in these Terms excludes a warranty, guarantee or consumer right that cannot legally be excluded.

19. Limitation of liability

To the fullest extent permitted by law, Bamio is not liable for indirect, incidental, special or consequential loss arising from ordinary use of the Services, including loss caused by reliance on AI Output, interruption or loss of learning opportunity, except where liability cannot legally be excluded or limited.

For an individual consumer claim where limitation is legally permitted, Bamio’s aggregate liability arising from the Services is limited to the greater of (a) the amount the consumer paid directly to Bamio for the affected Services during the 12 months before the event giving rise to the claim, or (b) INR 1,000. This cap does not apply to liability that cannot be limited under applicable consumer, data-protection, fraud, wilful misconduct or other mandatory law.

20. Indemnity for unlawful or unauthorized use

To the extent permitted by law, an adult user is responsible for losses reasonably caused by that user’s material breach of these Terms, unlawful use, infringement or content uploaded without authority. This clause does not require a consumer to indemnify Bamio for Bamio’s own negligence, unlawful processing, security failure or liability that cannot legally be shifted to the consumer.

21. Suspension and termination

You may stop using Bamio at any time and may request deletion as described in the Privacy Policy. Bamio may suspend or terminate access where reasonably necessary because of a material Terms violation, security risk, unlawful use, infringement, abuse, non-payment where applicable or a legal requirement.

For school-linked accounts, access may also change or end when the school changes enrollment, removes the student, changes the authorized role or terminates its agreement. Termination of Bamio access does not automatically erase academic records the school independently retains.

22. Changes to these Terms

Bamio may update these Terms as the Services or legal requirements change. Material changes will be notified through the app, email or another reasonable channel. Where applicable law requires renewed agreement or consent for a material change, Bamio will obtain it before relying on that change.

23. Force majeure

Bamio is not responsible for delay or interruption caused by events beyond its reasonable control, such as widespread internet or cloud outages, provider outages, cyberattacks, government action, natural disasters, power failures, labour disruption, war, epidemic or similar events, provided this clause does not excuse duties that cannot be excluded by law.

24. Governing law and disputes

These Terms are governed by the laws of India. Bamio encourages users to first contact admin@bamio.in with the subject “Dispute” so the matter can be reviewed and, where possible, resolved amicably.

Nothing in these Terms removes or restricts a consumer’s right to approach a competent consumer commission, data-protection authority, court or other statutory forum where that right is mandatory. Courts at Sri Muktsar Sahib, Punjab may have jurisdiction subject to mandatory consumer and other applicable jurisdiction rules. Arbitration may be used only where legally valid and appropriately agreed for the dispute; these Terms do not force a consumer to waive a non-waivable statutory forum.

25. Relationship with school agreements

If the student is school-linked, the school’s School Services Agreement and DPA govern Bamio’s commercial relationship with the school and the school’s processing instructions. These Parent & Student Terms govern the individual/family use of the app unless a specific clause states otherwise. No teacher or parent can amend the school’s institutional agreement unless authorized to do so.
